How SR-22 and FR-44 work in Virginia
An SR-22 isn't a type of insurance. It's a certificate your insurance company files with the Virginia Department of Motor Vehicles (DMV) to prove you carry at least the state minimum coverage. Virginia uses two of them. After a DUI, you need an FR-44, which works the same way but with double the minimum limits. An SR-22 is usually required after an unpaid crash judgment, driving an uninsured vehicle, not keeping insurance on your car, or a conviction such as hit and run, vehicle manslaughter or a felony involving a vehicle. You typically keep either one for 3 years from the date your suspension or revocation ends.
- Your insurance company or agent files the SR-22 or FR-44 with the Virginia DMV for you, electronically
- Keep the policy active the whole time. If it's canceled, your insurer notifies the DMV, and the DMV suspends your license until a new SR-22 or FR-44 is on file
- A licensed agent can quote it today and explain your options
Virginia minimum car insurance
For policies that start on or after January 1, 2025, Virginia requires at least $50,000 for injuries per person, $100,000 per accident and $25,000 for property damage, plus uninsured and underinsured motorist coverage at least equal to those limits. An FR-44 policy needs double: $100,000, $200,000 and $50,000. Since July 1, 2024, you can no longer pay a fee instead of insuring your car. Your SR-22 or FR-44 policy has to meet at least these limits.
No car? Non-owner SR-22 in Virginia
If you don't own a car, Virginia allows an operator's (non-owner) policy for an SR-22 or FR-44, which covers your liability when you drive a car you don't own. Ask the agent whether it fits your situation.

Virginia SR-22 and FR-44 questions
Who needs an SR-22 in Virginia?
The Virginia DMV usually requires an SR-22 after an unpaid crash judgment, driving an uninsured vehicle, not keeping insurance on your car or falsifying insurance information, or after a conviction such as hit and run, vehicle manslaughter or a felony involving a vehicle. After a DUI, Virginia requires an FR-44 instead, with double the minimum limits. If you aren't sure, ask the Virginia DMV or a licensed agent.
How long do I need an SR-22 in Virginia?
Typically 3 years from the date your suspension or revocation ends, or from the date a crash judgment is paid. The same goes for an FR-44, and you also need it on file while you have a restricted license. If you aren't sure of your dates, ask the Virginia DMV.
What happens if my SR-22 lapses in Virginia?
Your insurer sends the DMV a notice of cancellation, and the DMV suspends your license until a new SR-22 or FR-44 is on file. Line up a new one before you switch companies.
Can I get an SR-22 in Virginia without a car?
Yes. Virginia allows an operator's (non-owner) policy for drivers who don't own a vehicle, for an SR-22 or an FR-44. A licensed agent can quote one.
