How SR-22 works in South Dakota
An SR-22 isn't a type of insurance. It's a certificate your insurance company files with the Driver Licensing Program at the South Dakota Department of Public Safety (DPS) to prove you carry at least the state minimum coverage. South Dakota usually requires one after a DUI (even a first offense), vehicular homicide, a second reckless driving conviction within one year, a conviction for driving without insurance, or an unpaid court judgment from a crash. You typically keep it for at least 3 years from the date DPS requires it.
- Your insurance company files the SR-22 directly with DPS Driver Licensing for you. Driver exam stations can't accept SR-22 forms
- Keep the policy active the whole time. If it ends, your insurer has to tell DPS, and DPS suspends your license and registration until a new SR-22 is on file
- A licensed agent can quote it today and explain your options
South Dakota minimum car insurance
South Dakota requires at least $25,000 for injuries per person, $50,000 per accident and $25,000 for property damage, often written as 25/50/25. Every policy also has to include uninsured and underinsured motorist coverage at the same injury limits. Your SR-22 policy has to meet at least these limits.
No car? Non-owner SR-22 in South Dakota
If you don't own a car, South Dakota law allows an operator's (non-owner) policy, which covers your liability when you drive a car you don't own. Ask the agent whether it fits your situation.

South Dakota SR-22 questions
Who needs an SR-22 in South Dakota?
DPS usually requires one after a DUI conviction, even a first offense, or after vehicular homicide or a second reckless driving conviction within one year. A conviction for driving without insurance or for showing false proof of insurance also requires one, and so does an unpaid court judgment from a crash. If you aren't sure, ask the DPS Driver Licensing Program or a licensed agent.
How long do I need an SR-22 in South Dakota?
Typically at least 3 years from the date DPS requires it. DPS releases it after 3 years only if it has no record of a new conviction in that time that could suspend your license. If you aren't sure of your dates, ask the DPS Driver Licensing Program.
What happens if my SR-22 lapses in South Dakota?
Your insurer has to tell DPS within 15 days after the policy is cancelled, and DPS suspends your license and registration until a new SR-22 is on file. Line up a new SR-22 before you switch companies.
Can I get an SR-22 in South Dakota without a car?
Yes. South Dakota law allows an operator's (non-owner) policy for drivers who don't own a vehicle. A licensed agent can quote one.
