Does New York use the SR-22?

No. New York doesn't use the SR-22 for its own drivers. Your insurance company reports your coverage straight to the New York Department of Motor Vehicles (DMV) electronically, and that record is the state's proof. After a DWI, a refused chemical test or a conviction for driving without insurance, New York suspends or revokes your license instead. To get it back, you finish that time, pay any civil penalty and fees, and get DMV approval. An SR-22 only comes up if another state needs one from you, for example after a DUI in that state or an SR-22 order from a state you moved from.

  • Your insurance company reports your New York coverage to the DMV electronically. Paper cards and emails don't count
  • If your coverage ends, turn in your plates or replace it right away. A lapse suspends your registration, and a lapse of 91 days or more suspends your license too
  • Need an SR-22 for another state? A licensed agent can tell you which companies can file it there

New York minimum car insurance

New York requires at least $25,000 for injury to one person and $50,000 for injuries to two or more people, $50,000 for the death of one person and $100,000 for two or more, and $10,000 for property damage. It has to be New York insurance from a company licensed by the state. The DMV doesn't accept out-of-state insurance.

No car? Non-owner insurance in New York

If you don't own a car, New York law recognizes an operator's (non-owner) policy, which covers your liability when you drive a car you don't own. Not every company sells one. Ask the agent whether it fits your situation.

New York SR-22 questions

Does New York require an SR-22?

No. New York doesn't use the SR-22 for its own drivers. Your insurance company reports your coverage to the DMV electronically. After a DWI, a refused chemical test or driving without insurance, the DMV suspends or revokes your license, and you get it back by finishing that time, paying any civil penalty and fees, and getting DMV approval.

What if another state wants an SR-22 from me?

That state's rules still apply, even after you move to New York. Ask a licensed agent which companies can file an SR-22 with that state for you.

What happens if my insurance lapses in New York?

Turn in your plates or replace the coverage right away. The DMV suspends your registration for as many days as you had no coverage, and if the lapse lasts 91 days or more, it suspends your license for the same number of days.

What happens if I drive without insurance in New York?

A conviction revokes your license for at least one year. You pay the DMV a $750 civil penalty before you can get a new license, and the court fine can be as much as $1,500.
